Terms & Conditions


This website is owned and operated by Factory Heaters Limited. By using this website, you agree to the following terms of use which, together with the privacy policy should be read and accepted, by you, prior to any activity or purchase. You accept that by purchasing any of the Goods, you agree to be bound by the terms and conditions of sale and purchase below. By becoming a user you acknowledge that you have read and understood the relevant terms and conditions and that you agree to be bound by all of its provisions. DEFINITIONS

  • “Company” shall mean Factory Heaters Limited whose registered office is at :- 149 Halton Road, Runcorn, Cheshire WA7 5QX.
  • “Buyer” shall mean the person, firm or company with whom the Contract is made, or from whom an order is received by the Company.
  • “Contract” shall mean any agreement between the Company and the Buyer for the sale and purchase of the Goods.
  • “Delivery”, unless otherwise agreed with the Buyer, will be on an ex-works basis when the Goods are made available for collection by the Buyer at an agreed location.The Goods are deemed to have been delivered whether or not they have been signed for by either the Buyer or the Buyer’s agent.
  • "Goods” shall mean the products agreed in the Contract to be supplied to the Buyer by the Company and shall include all appliances and accessories covered by the Contract. Any requirement for installation, commissioning or other services are not covered by “Goods” agreed in the contract for supply to the buyer, and would need to be covered under any separate contract agreed between the Buyer and their chosen Gas Safe Registered Engineer.
  • “Price” means the value of the Goods to be supplied, excluding carriage and VAT.


CONTRACT

  • Any order placed by the Buyer, constitutes a contract between the Company and the Buyer.
  • Unless otherwise agreed in writing by the Company, these conditions shall form part of any contract based on orders placed by the Buyer.
  • All technical data, physical dimensions, capacities and other properties and particulars including drawings are made in good faith as being approximately correct but deviation therefrom shall not vitiate the contract nor be made the basis of any claim against the Company.
  • The contract between the Company and the Buyer, which is subject to these conditions, is to be construed and to take effect as a contract made in England and in accordance with English Law, and any disputes arising therefrom shall be determined in the Courts of England or, at the Company’s discretion, shall be referred to a single mutually acceptable arbitrator in accordance with the provisions of the Arbitration Act currently in force. 



PRICING

  • All prices offered in the Company’s on-line store are exclusive of VAT and carriage and any other duties which may become payable.
  • All prices offered in the on-line store may be changed by the Company without notice.
  • All orders are accepted for delivery at the price ruling at the date of despatch.
  • For deliveries within mainland GB, excluding The Highlands, pricing offered in the on-line store will only be subject to the addition of VAT, with no charge for delivery imposed (ZONE A)
  • For deliveries to addresses outside of mainland GB i.e The Highlands & Islands,Isle of Man, Isle of Whyte, Northern Ireland, Ireland, Channel Islands, the cost of delivery will be subject to quotation and will need to be added to the order value during order placement (ZONE B)


PURCHASES

  • The Buyer can make a purchase either :-
  • Directly from the Company’s on-line store at www.factoryheaters.co.uk
  • Or via telephone on +44 (0)1928 611002 PAYMENT
  • The total purchase price, including VAT and delivery charges where appropriate, will be displayed in the Buyer’s shopping cart prior to confirming the order.
  • VAT at the UK standard prevailing rate is added to all orders. Currently this rate is 20%.
  • Total payment of the Goods plus VAT and delivery charges, if applicable, must be made during the checkout process, in advance of shipment / delivery.
  • Payment can be made using Visa, VisaDebit, Mastercard, American Express or Apple Pay.
  • Where applicable, if any payment is not paid on time, or any payment is rejected or refused, the amount owing will be treated as overdue and the Company will be entitled immediately to cease or suspend the delivery of Goods until payment has been received.


CREDIT CARD SECURITY

  • When an order is placed in the Company’s on-line store, credit card numbers are encrypted. They are only decrypted after they reach the Company’s computer. They are not held in clear text on any website. The Company DO NOT store the Buyers credit cards details.


BUYERS LIABILITY

  • Goods are supplied from the Company, only for the purpose for which they are specifically designed and which is clearly defined in the appropriate installation manual (available to view in the Company’s on-line store prior to purchase). The Company do not accept liability for damage or injury caused as a result of the equipment being used for any other purpose.
  • Whilst the Company can advise the Buyer as to the suitability of Goods for specific requirements, there are many factors outside of the Company’s control in respect of the performance of Goods, so the Buyer is entirely responsible for the type of Goods purchased and for the capacity of the Goods to be suitable with the proposed application. The Company do not accept any liability for incorrect calculations, incompatible designs or advice which may result in the equipment supplied not being suitable for the purpose for which it was purchased.
  • The Company will accept no liability for failure of products to attain any performance figure, unless the Company has specifically guaranteed that figure, or unless that figure is quoted in the on-line store and is in force at the date of delivery.
  • It is the Buyers responsibility to ensure that the Goods and other materials utilised in the application are installed and commissioned by an approved Gas Safe Engineer, and in accordance with the manufacturers instructions (available to view in the Company’s on-line store prior to purchase). Any non-conformance of these requirements will invalidate the warranty of the Goods supplied. 


DELIVERY



RETURNS POLICY

  • The Buyer is entitled to cancel an order and return the goods within 14 working days for a full refund, including the cost of delivery. Do this by contacting the Company by email or telephone and quoting the order / invoice number supplied to the Buyer
  • Any goods returned should be unused, in the original packaging and in a saleable condition.
  • Subject to Goods being received in a saleable condition, the refund will be paid within 30 days.
  • The Buyer is responsible for the cost, and risk of loss or damage, when returning the goods, so the Buyer should take out enough postal insurance to cover their value. This cancellation policy does not affect the Buyers rights when the Company are at fault - for example, if goods are faulty or misdescribed.


WARRANTY

Whilst product warranty will vary dependent upon the appliance manufacturer, all appliances are sold with a minimum of 12 months warranty, after which appliances must be serviced in order to maintain the integrity of warranty claims. The Company specifically do not accept liability for financial or consequential losses, expenses or damage occasioned by defects in manufacturing or arising as a result of, but not limited to improper installation, non-conformance of manufacturer’s instructions, non-commissioning, or incorrect application. Proof of service will therefore be required on all warranty claims made after the initial 12 month period has elapsed.


Faults and any associated costs occurring due to lack of fuel, power, water supply or scale formation are not covered by manufacturers warranties.


The Manufacturers Warranty against Goods delivered by the Company is subject to compliance of the following conditions:


  • All goods are supplied with the manufacturers warranty, subject to the conditions listed below.   
  • All gas appliances and components MUST BE installed by a competent person. It is the law that all gas appliances are installed and serviced by a competent person in accordance with current gas regulations, building regulations, codes of practice and bylaws of the relevant local authority. To avoid confusion and doubt, the Company deem a competent person to be a Gas Safe Registered Installer / Engineer.
  • All Goods MUST BE installed in accordance with the manufacturer's instructions.
  • Proof of installation and / or a commissioning certificate from a Gas Safe Registered Installer/ Engineer, in accordance with the manufacturer's instructions.
  • All appliances are regularly serviced and maintained by a Gas Safe Registered Installer/ Engineer, in accordance with the manufacturer's instructions.
  • The manufacturers warranty is given to the original buyer of the goods as part of the Contract with the Company, and is not transferable to a third party. (e.g. where the products have been sold on to contractor / end-user via a wholesaler/merchant.
  • The statutory rights of the buyer are not affected by the warranty.


WARRANTY CLAIM

 If Goods supplied develop a fault within the manufacturers warranty period, the buyer should contact the manufacturer directly :-


  • HAVE PROOF OF PURCHASE AVAILABLE
  • ADVISE MANUFACTURER OF PURCHASE DETAILS
  • PROOF OF COMMISSIONING MUST BE PROVIDED WITH EVERY WARRANTY CLAIM
  • EXPLAIN WHAT PROBLEM IS 
  • DISCUSS WARRANTY STATUS / RESOLVE PRODUCT ISSUE WITH MANUFACTURER

FORCE MAJEURE

  • The performance of all contracts is subject to variation or cancellation by the Company without notice owing to any Act of God, war, strikes, lock-outs, fire, flood, drought, tempest, pandemic or any other cause beyond the control of the Company, or owing to any inability of the Company to procure materials or articles required for the performance of the contract and the Company shall not be held responsible for any inability to deliver caused by any such contingency


AMENDMENT OF TERMS

  • These terms apply to each order.
  • The Company may change the terms and conditions at any time, so please do not assume that the same terms will apply in the future.
  • None of these terms affect the Buyers legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms.
